Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the IPDips platform, website, and related services (“Service”).

By creating an account or using IPDips, you agree to these Terms.

1. Definitions

• “Service” — the IPDips monitoring and alerting platform
• “Customer” / “you” — the individual or entity using the Service
• “Check” — a configured uptime or performance test
• “Content” — configuration data and endpoints provided by the Customer
• “Subscription” — a usage-based or prepaid billing plan

2. Account Registration

• You must provide accurate and complete information
• You are responsible for safeguarding your credentials
• You must be at least 16 years old to use the Service

3. Subscriptions & Billing

• IPDips uses consumption-based pricing and/or prepaid bundles
• Charges are based on executed checks and selected add-ons
• Fees are non-refundable except where required by law
• Failure to pay may result in suspension or termination

4. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Monitor systems without proper authorisation
• Attempt to disrupt or overload the Service
• Reverse engineer or copy platform functionality

Violations may result in suspension or termination.

5. Service Availability

IPDips aims to provide a reliable Service but does not guarantee uninterrupted availability.

Planned maintenance and unforeseen outages may occur. Enterprise plans may include separate SLA agreements.

6. Fair Use

To ensure platform stability:

• Usage must remain within reasonable technical and commercial limits
• Excessive or abusive usage may require plan adjustment
• We will contact you before applying restrictions where feasible

Fair use policies ensure consistent performance for all customers.

7. Content Ownership

You retain all rights to your data and configurations.

You grant IPDips a limited, non-exclusive licence to process your Content solely to provide the Service.

IPDips does not claim ownership of customer Content.

8. Data Protection & Privacy

IPDips processes personal data in accordance with:

• Its Privacy Policy
• Its Cookie Policy

Analytics tools may be used to understand aggregate website usage, in compliance with applicable data protection laws.

A Data Processing Agreement (DPA) is available upon request.

9. Liability

To the maximum extent permitted by Dutch law:

• IPDips is not liable for indirect or consequential damages
• Total liability is limited to fees paid in the previous 12 months
• This limitation does not apply to liability arising from gross negligence or wilful misconduct

10. Termination

You may terminate your account at any time.

IPDips may suspend or terminate access if you:

• Violate these Terms
• Abuse system resources
• Fail to pay outstanding invoices

Upon termination, access to the Service will cease.

11. Governing Law & Jurisdiction

These Terms are governed by Dutch law. Disputes shall be submitted to the competent court in The Netherlands, unless mandatory EU law provides otherwise.

12. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via the platform or email.
